Welcome to PHE. These Terms of Service apply when you visit our website or purchase products from us. By placing an order with PHE, you agree to these terms.
1. ABOUT US
PHE is an independent clothing brand based in the United Kingdom.
Throughout these terms, “PHE”, “we”, “us” and “our” refer to PHE. “You” and “your” refer to the customer or website user.
2. OUR PRODUCTS
We aim to display our products, colours, descriptions, sizing and photographs as accurately as possible.
Colours may appear slightly different depending on your device or screen settings. As our products are manufactured in production runs, minor variations may also occur between items.
We reserve the right to update product information, pricing and availability where necessary.
3. PRE-ORDERS
Some PHE products are offered on a pre-order basis.
By purchasing a pre-order product, you acknowledge that the item is not immediately available for dispatch and agree to the estimated dispatch timeframe displayed on the product page or otherwise communicated to you before purchase.
Any delivery or dispatch dates provided for pre-orders are estimates unless expressly stated otherwise.
We will aim to keep customers informed if there is a significant delay affecting their order.
Your statutory consumer rights are not affected by purchasing an item on pre-order.
4. ORDERS
When you place an order, you are responsible for ensuring that the information you provide, including your delivery address and contact information, is accurate.
You will receive an order confirmation after successfully placing your order.
We reserve the right to cancel or refuse an order where reasonably necessary, including where there has been an obvious pricing error, suspected fraudulent activity, payment failure or an item has become unavailable. Where we cancel an order after payment has been taken, the appropriate refund will be issued.
5. PRICES & PAYMENT
All prices are displayed in GBP (£) unless otherwise stated.
The total amount payable, including any applicable delivery charges, will be shown during checkout before you place your order.
Payment must be successfully completed before an order is confirmed.
Discount codes are subject to any conditions communicated with the offer. Unless otherwise stated, discount codes cannot be exchanged for cash.
6. SHIPPING & DELIVERY
Delivery estimates and applicable shipping charges will be displayed or communicated during the ordering process.
Pre-order products have different dispatch times from products held in stock. Please check the relevant product page before ordering.
Once your order has been dispatched, you may receive tracking information where tracked delivery is available.

7. CANCELLATIONS, RETURNS & REFUNDS
Your cancellation, return and refund rights are explained in our separate Refund Policy.
Nothing in these Terms of Service is intended to limit or exclude any rights you have under applicable UK consumer law.
Where you have a statutory right to cancel an online purchase, this right will continue to apply in accordance with applicable law.
8. FAULTY OR INCORRECT ITEMS
If you believe you have received an item that is faulty, damaged or different from what you ordered, please contact us as soon as reasonably possible with your order details.
Your statutory rights in relation to faulty, damaged or misdescribed goods are not affected by these terms.
9. WEBSITE USE
You may use our website for personal, lawful purposes.
You must not misuse the website, attempt to interfere with its operation, introduce malicious software, attempt unauthorised access, or use our content for unlawful purposes.
10. INTELLECTUAL PROPERTY
Unless otherwise stated, the content appearing on the PHE website, including our branding, photographs, graphics, product designs, text and other original content, belongs to PHE or is used by us with permission.
You may not reproduce, distribute or commercially exploit our content without permission, except where permitted by law.
11. PROMOTIONS & DISCOUNT CODES
From time to time, PHE may offer discounts, early access or promotional offers.
Promotions may be subject to specific eligibility requirements, expiry dates or other conditions.
We reserve the right to withdraw or amend a promotion where reasonably necessary, provided this does not affect orders already validly placed using that promotion.
12. LIABILITY
Nothing in these terms excludes or limits liability where doing so would be unlawful.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses arising from circumstances outside our reasonable control, except where the law provides otherwise.
Nothing in these terms affects your statutory consumer rights.

We process personal information in accordance with our Privacy Policy.
By using our website or placing an order, you acknowledge that your information will be processed as described in that policy.
14. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our business, website or applicable requirements.
The terms applicable to your purchase will be those in effect when you place your order.

These terms are governed by the applicable laws of the United Kingdom.
Nothing in these terms affects any mandatory consumer rights or protections available to you under applicable law.
